The Indian seeds industry has called for stronger enforcement of intellectual property rights (IPR) in the sector, emphasizing its vital role in driving agricultural growth and ensuring food security. At a recent conference in Hyderabad, industry experts highlighted that robust IPR enforcement would protect innovation, attract investments in research and development, and promote technology transfer. Organized by the Federation of Seed Industry of India (FSII) in collaboration with the Government of Telangana and the Protection of Plant Varieties and Farmers’ Rights Authority (PPVFRA), the event underscored the need to secure high-quality and safe seeds for farmers, thus fostering sector growth and benefiting both farmers and consumers.

Importance of Innovation in Agriculture
India’s agriculture sector is undergoing a significant transformation, driven by technological advancements and innovative practices. Prime Minister Narendra Modi’s launch of 109 high-yielding, climate-resilient, and biofortified seeds marks a new era for Indian agriculture. Experts at the conference stressed that strong IPR enforcement in seeds would further accelerate this progress, creating an environment that encourages sustainable agricultural development. Dr. Trilochan Mohapatra, Chairperson of PPVFRA, remarked, “High-performing seed varieties, developed through intensive research, have significantly boosted agricultural production and economic growth. As India’s population is projected to reach 1.7 billion by 2050, the demand for food grains is expected to soar to 400 million tonnes. A joint study by CropLife International and EuropaBio underscored the importance of IPR in promoting agricultural innovation. It highlighted that innovative crops have revolutionized farming practices, significantly boosting global agricultural productivity. Hybrid seeds, in particular, have already contributed an estimated EUR 75 billion to farm incomes globally. Effective IPR enforcement, therefore, plays a pivotal role in fostering transformative growth in agriculture.
Challenges and Solutions for IPR Enforcement
However, the path to effective IPR enforcement in India’s seed sector is not without obstacles. Many farmers, especially small and marginal ones, are often unaware of IPR laws, leading to unintentional infringements. Weak enforcement mechanisms, lengthy judicial processes, and the need to balance farmers’ and breeders’ rights are some of the persistent challenges. FSII Advisor Ram Kaundinya stressed the importance of educating law enforcement authorities and the judiciary at the grassroots level to better understand seed-related intellectual property. He added that states that implement strong enforcement mechanisms would gain a competitive advantage in attracting seed research investments and production contracts.
Towards a Balanced Approach
Addressing these challenges requires a balanced approach that recognizes the rights of both farmers and breeders. Leveraging technologies such as blockchain for tracing, reforming judicial processes, and encouraging dialogue between stakeholders—including seed companies, farmers, government agencies, and civil society—will be crucial in overcoming IPR enforcement challenges in India’s seed sector.
